Divorce Case

Medium length marriage in Oconto County.  Wife files for divorce against our client.  Our client has a significant amount of money in his retirement account through his employer.  Client was able to keep all of the money that he had in his retirement account and was happy with the custody and placement arrangement agreed upon for the parties' child.

Custody / Placement Case

Our client's ex-boyfriend filed a motion in court to have more time with the parties' child.  The ex-boyfriend was suspected of using illegal drugs.  Attorney with Schwitzer Simon, LLC worked out an arrangment where the ex-boyfriend would have to submit to a drug test after a certain period of time, and if he failed the drug test the placement arrangment would immediately require that the ex-boyfriend's placement be supervised at his expense.

Long term marriage in Green Bay.  Wife hired attorney with Schwitzer Simon, LLC.  Marital settlement agreement included an award of maintenance to our client along with a balancing payment to our client of over $180,000.

Custody / Placement Case

Mother had primary physical placement of her daughter.  Father filed motion seeking primary physical placement of the parties' child.  Our client (mother) opposed this change in placement.  The Guardian ad Litem (GAL) recommended to the Court that the father should be awarded more placement time with the child.  Attorney with Schwitzer Simon, LLC argued in opposition to the father's request and the GAL's recommendation.  The Court issued a decision and order in favor of our client.

Our client (father) lived outside of Wisconsin.  Mother lived in Green Bay area and had placement of child.  Mother was withholding placement from our client and not allowing our client to see the child.  Attorney with Schwitzer Simon, LLC filed a motion in court for court ordered mediation, to enforce the current placement order, and to allow the father more time during the summer break with his child.  The court did order mediation, which resulted in our client receiving a court order for additional placement.

Divorce

Our client (father/husband) was stay at home parent to the parties' minor child.  Parties were continuing to reside together in the same home after the divorce papers were filed, but were not getting along.  Attorney with Schwitzer Simon, LLC successfully argued to the court to have spouse removed from the home while the divorce was pending.  Upon divorce our client was awarded child support and maintenance.

Custody / Placement Case

Our client (mother) was seeking shared placement of her two children after moving back to Northeast Wisconsin after having moved out of the area after difficult divorce several years ago.  Father objected and wanted to keep primary placement.  Attorney with Schwitzer Simon, LLC filed motion to change the placement agreement to allow our client 50/50 placement.  Aggressive negotiations with father's attorney resulted in our client getting shared placement of her two children.

Grandparents Rights and Placement

Mother of 3 children were not allowing paternal grandmother to see the children and the children's father was in prison.  Grandmother hired attorney with Schwitzer Simon, LLC, who filed a motion in court.  Attorney successfully obtained visitation rights for the grandmother to see the children on a regular basis.

Our client (mother) was serving in the armed forced here in Green Bay, Wisconsin.  After her service was complete she wanted to move out of state back to her home town to be closer to her family, and she wanted to take her young son with her.  Attorney with Schwitzer Simon, LLC filed a notice of her intent to move out of state.  The father objected to her moving.  A Guardian ad Litem became involved and began an investigation.  Attorney with Schwitzer Simon, LLC successfully negotiated a settlement which allowed the mother to move out of state and to maintain primary placement of her child in addition to continuing to receive monthly child support payments.
